The trial of Azeez Fashola, also known as Naira Marley, continued today, July 15, 2022, before Federal Supreme Court Justice I. Nicholas Oweibo, sitting in Ikoyi, Lagos, with a prosecuting witness, Dein Whyte, an EFCC aide. who continues his evidence even though the court rejected the defendant’s objection to the forensic evidence previously presented by the witness.
NairaMarley faces charges of 11 counts bordering on credit card fraud brought against him by the EFCC.
During the last hearing on June 9, 2022, defense counsel, Olalekan Ojo SAN, had objected to the witness’s opinion on the forensic evidence linking the defendant to credit card fraud. He had argued that only the court could rule on the guilt of the accused, not an investigator.
At today’s resumed trial, Judge Oweibo issued a brief ruling dismissing the defense’s objection.
“It is the duty of the law enforcement agency or police to take a person to court to investigate whether the accused committed the crime or not. The detective must be able to link the suspect to the commission of the crime. The public prosecutor must have made a decision about the suspect’s involvement before taking the case to court. I do not agree that the prosecution has found the accused guilty,” the judge ruled.
