It is no exaggeration to say that my prediction in April that the Supreme Court was set to start a war with modern America was accurate about decades of social and legal progress.
The majority of Dobbs v. Jackson Women’s Health Organization’s opinion, with a tone more reminiscent of a MAGA rally than the High Court, overturns the right to abortion, drips with disdain for women’s concerns about individual autonomy and the principles of case law. Fall-The doctrine that the court adheres to to set a precedent in making their decisions.
This particular opinion is bad, but the big picture is more than abortion.
Right-wing courts want to confine America in the 21st century to the world of its founding father, or at the latest in the late 19th century.
Women, minorities, gay people, and 11 others had little political, economic, or social power. And if the court gives way, they will do it again.
Look carefully at the court’s words that bounce throughout history. “Until the second half of the 20th century, such rights [to abortion] It was completely unknown under American law. ” The last 50 years when the Roe v. Wade case tracked a series of previous cases of personal autonomy (“privacy”) are not counted.
The court alleges that our rights under the Fourteenth Amendment to the Constitution were amended in 1868. Therefore, as the dissenting opinion explains, we have terrible consequences. “”
In 1868, women were denied many rights. Gay people and underage children did not have the right to speak and had no physical or mental disabilities.
This court declares that we are sticking to the exact state of pre-civil rights, pre-women’s rights, and pre-modern law. The idea that freedom and equality have ever expanded is Caputo. The moral universe bends backwards.
How radical is this? Now, Judge Clarence Thomas provided the answer by arguing in his consensus that the court should reconsider rights far beyond abortion. Therefore, it is incorrect to say “Roeison the ballot” in November. The 21st century is on the ballot.
Republicans at all levels of government supported the decision.
This is a radicalist party, despising modern America where white men cannot make all the rules.
And it will get worse. Wait until the court considers a North Carolina case in which the legislature can stop its own coup by overturning the public vote on the president if the legislature is not suitable for parliament.
Are we destined to ride a Republican time machine in the 19th century? Certainly not.
First, Congress can act to secure all the rights that Thomas has identified for the chopping block. Let Republicans interfere with abortion, contraception, interracial and same-sex marriage proceedings.
If so, voters can send Democrats with enough courage to fix filibusters to protect their fundamental rights.
Second, the Supreme Court sends the most personal and intimate decisions to the state legislature and governors, local lawyers and judges, so those who desire the 21st century constitutional system are those who respect basic rights. Must meet all those offices with. .. ..
The 21st century vs. the 19th century is a problem in every election.
