No convictions for three men charged after sexually assaulting rugby player outside Pōneke club rooms

Three brothers charged with assaulting a rugby player after a brawl outside Pōneke’s Kilbirnie . clubrooms have all escaped condemnation.

The three men now have permanent name suppression.

The fight, in July 2020, left a Pōneke player with serious injuries and prevented him from playing rugby.

On Friday, the last of the three had his case heard by Wellington District Court judge Bruce Davidson​, who dismissed him without conviction on a accusation of injuring with reckless contemptand ordered him to pay a $600 emotional damage reparation.

The judge had made the dismissal conditional on the man having performed 60 hours of community service and saving the money for reparations.

Players from rival Wellington clubs were involved in a brawl in July 2020 that left two people hospitalized. (Video first published in May 2021.)

The man and his brothers had been to a meeting in the clubrooms where two groups were arguing inside.

Outside the rooms, he had struck the victim from behind and then knocked him unconscious.

The victim had symptoms of a concussion, had to undergo dental repairs and was upset and upset.

One brother – who was charged with habitual assault – was also discharged without conviction to preserve his future sports career, while the third brother was dismissed on charges.

The judge said it was an alcohol-fueled altercation between the two groups.
