After announcing his retirement earlier this year, U.S. Supreme Court Justice Stephen Breyer will formally end his tenure on the nation’s Supreme Court on June 30, shortly after the court renders two remaining sentences of this term.

In a June 29 letter to President Joe Biden, Judge Breyer said his retirement from active duty, after nearly 30 years on the bench, will take effect Thursday at noon, two hours after the judges for a summer recess issued final opinions.

“It was a great honor for me to participate as a judge in the effort to uphold our constitution and the rule of law,” Judge Breyer wrote.

Ketanji Brown Jackson, who was nominated by the president and confirmed in the US Senate earlier this year, will be formally sworn in as the first black woman and the first former public defender to sit on the nine-member court.

Judge Jackson, a former clerk to Judge Breyer, is willing to “take the prescribed oath to begin her service,” he said.

She will be sworn in on June 30 at noon.

According to a court statement, Chief Justice John Roberts will take the constitutional oath and Judge Breyer will take the judicial oath in a small ceremony attended by members of Judge Jackson’s family.

Thursday, before the end of the tenure and the retirement of Judge Breyer, the judges are expected to give their opinion in two high-profile cases: Biden vs Texason the so-called “Stay in Mexico” measure, and West Virginia v Environmental Protection Agency, which could determine how and whether the federal government can regulate CO2 emissions.

It is also likely that pending requests and petitions to the court will be decided before the recess on Thursday.

The court will return for its conferences at the beginning of its next term, which begins later this year, and begin hearing pleadings in other cases.

Judge Jackson’s confirmation of the court is unlikely to change the balance of the court’s conservative majority.

The retirement of 83-year-old Judge Breyer — one of three liberal-minded judges on the court, along with Elena Kagan and Sonia Sotomayor — follows a controversial term in which the court’s new conservative majority abolished a constitutional right to abortion care. that a New York hidden-carrying bill violated the Second Amendment, ruled in cases that could increase religious influence in public schools, and reinstated Republican-signed congressional cards that other courts found violated the Voting Rights Act.
