Jacob Paul Selby is accused of assaulting a student at the Huia Range School in Dannevirke.

A child was left in tears with a scar on his neck after being attacked at school by a teacher, a court has heard.

But the assistant will tell the court that it didn’t work out that way, his lawyer says.

Jacob Paul Selby pleaded not guilty to assaulting a child at Dannevirke’s Huia Range School in 2020 at the start of his trial in the Palmerston North District Court on Wednesday.

One child, who is automatically given name suppression, said they were attacked by Selby at the end of a school day while students were cleaning up the classroom.

The child said they went to the back of the class and asked if people needed help before being told by Selby to leave.

Selby then used his chest to push them away and grabbed them by the throat as well, the child said.

The child was pushed until they hit a desk, they said.

After going outside to calm down, they went to their mother’s car while their mother talked to a teacher, while Selby walked by and said, “Oh, you’re still crying, little baby,” the child said.

Selby’s attorney Laurie McMaster presented the child with a different scenario, in which they did not listen to instructions before trying to “drop the shoulder” and elbow Selby in the groin.

Selby responded by raising his hands to avoid getting hit, she said.

The child said that was not correct and noted that they had a red spot on their neck.

The child’s mother, who cannot be named as it would identify the child, said she saw her child not well when she went to school.

Her child told her that Selby had pushed them away with his hands around their throats.

She saw what appeared to be a thumbprint on her child’s neck—it was about the size of her thumb—but she couldn’t get the mark to appear in photos.

The child’s teacher, Anna Peffers, said she had asked the child to clean up several times.

She later heard Selby, who could be “reactive” when children were disrespectful, yelling at the child.

The child left the room, something children often did when excited, and it took a while for the child’s mother to come in and tell her that Selby had hurt the child.

Peffers later spoke to Selby, who said he had tried to use his body to force the child back into a certain part of the room.

The child had raised a hand that looked like it was going to lash out, so Selby raised a hand that landed on the child’s neck.

“I said, ‘I don’t think this has been such a good thing,'” Peffers said.

McMaster presented to Peffers, Selby would testify and say the direct comment was not made.

Peffers said she didn’t think she was mistaken.

The trial for Judge Jonathan Krebs and a jury continues.
