An Auckland tenant has canceled his lease after his guests peed in an elevator of his apartment building, despite repeated warnings to keep them under control.
The Rent court heard tenant Sioeli Pilkington Langi has breached his obligations as a tenant by making excessive noise that his neighbors in the Harvard Apartments in the CBD.
His guests urinated in the shared elevator twice, the tribunal heard.
arbitrator Robert Kee said: in his decision, the tenant had proved that he could not control his disruptive behavior or inconsiderate guests, despite having been warned.

“Apartment inmates should not tolerate such disgusting behavior as urinating in their shared space,” he said.

The legal entity of the building charged Langi’s landlord $1242 in call-out and handling fees due to the tenant and his guests, which Kee instructed the tenant to pay.
Kee had previously heard another request from the landlord to end Langi’s lease, but he declined that request “by a fine margin.”
In the first filing, the landlord cited nine separate incidents of bad behavior by the tenant, including allowing guests to vomit and draw graffiti in communal areas.
Kee then said he “notified the tenant” that if there were more incidents of antisocial behavior, the lease would be terminated.
“The tenant must realize that he is responsible for the behavior of his guests and this can lead to termination of the lease.”
The tenant also had to forfeit $1009 in security deposit to repay his landlord for the legal entity’s fees he incurred due to excessive noise.
Kee ruled it would be “unjust” not to terminate the lease and returned ownership of the apartment to Point Property and Portfolio Management Limited.
